These Terms of Sale set out the terms and conditions on which products are supplied to customers purchasing through nestogroup.com, the Nesto Hypermarket mobile applications, and any related digital channels. By placing an order through the Platform, you agree to be bound by these Terms of Sale.
Products are supplied by Nesto Hypermarket stores, fulfillment centers, dark stores, and authorized Nesto suppliers and partners as identified on the Platform.
Your order becomes accepted only when Nesto confirms via Email, SMS, Mobile App Notification, or WhatsApp Notification. Nesto reserves the right to refuse or cancel any order before shipment or fulfillment.
Orders may be cancelled before fulfillment begins. Orders containing fresh produce, meat, seafood, bakery items, or prepared foods may not be cancellable once picking has commenced.
Nesto may cancel orders where products become unavailable, payment authorization fails, fraud is suspected, delivery address is invalid, regulatory restrictions apply, or bulk purchasing abuse is detected.
All prices displayed include applicable VAT unless stated otherwise. Nesto reserves the right to correct pricing errors, modify prices, withdraw promotions, and cancel orders resulting from technical pricing mistakes.

Delivery times are estimates only and are not guaranteed.
Customers must be available at the delivery address during the selected delivery slot. Repeated failed delivery attempts may result in order cancellation.
Ownership and risk pass to the customer upon successful delivery or collection.
Fresh products (fruits, vegetables, meat, seafood, bakery, deli) may vary in weight, size, appearance, and packaging. Final billed amounts may be adjusted based on actual packed weight.
Where an item becomes unavailable during picking, equivalent substitutes may be offered. Customers may select substitution preferences at checkout and may accept or reject substitutions accordingly.
Customers selecting Click & Collect must collect orders within the designated collection window. Uncollected orders may be cancelled and refunded according to Nesto policies.
Certain non-perishable products may be returned within 15 calendar days, subject to original packaging, unused condition, and category restrictions.

Warranty exclusions include physical damage, water damage, unauthorized repair, product misuse, and normal wear and tear.
Nesto may operate Nesto Rewards, Cashback Programs, Coupons, Membership Programs, and Loyalty Campaigns. Nesto reserves the right to modify, suspend, or terminate promotions at any time.
Products and services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Nesto disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Nesto shall not be liable for indirect losses, consequential losses, business interruption, loss of profits, or loss of data.
These Terms of Sale shall be governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the UAE.
